Man arrested after assaulting an officer

A Denver man was arrested this week and is being charged with possession of a controlled substance and assault of an officer with a motor vehicle.

Sidney police officers arrested 35-year-old Justin Lane, on Monday after he attempted to run from law enforcment.

According to the police affidavit, on August 15 at approximately 8:03 p.m. a vehicle, driven by Lane was observed with no visible registration. The vehicle was stopped near the intersection of 18th Ave. and Fourth Street.

After asking Lane to step back to the officers vehicle, Lane provided a false name and date of birth. Lane was unable to provide the officer with any documentation stating the car belonged to him, claiming he had just purchased the vehicle.

The arresting officer checked the car’s vehicle identification number, with the car coming back as stolen.

The affidavit stated, the officer exited his patrol car and asked Lane to do the same. When Lane was told he was being place under arrest, he began to run. After being advised to stop, and failing to do so, Lane headed west and was tased by the officer.

Before the officer was able to apprehend him, Lane attempted to get up again and was tased once more, striking his face and head against the ground.

According to the arrest affidavit, that is when Lane was alledged to have struck the arresting officer in the back of the head before running away. The officer was able to apprehend and get Lane on the ground when officer assistance arrived on the scene.

Lane was read his Miranda warning at approximately 8:30 p.m. and the report said Lane admitted swallowing heroin and injection methamphetamine approximately two hours prior to the indecent.

Lane and the arresting officer were transported to Sidney Regional Medical Center (SRMC) for evaluation and later released.

Lane was cleared for incarceration by SRMC and is currently being held in the Cheyenne County Jail on $50,000 bond.

According to the affidavit, upon inspection of Lane’s car an inventory of multiple syringes, two glass pipes with burnt marijuana residue, and a small ID holder that contained a white powdery substance that was later tested and showed a “presumptive positive” for the presence of heroin.

Lane is formally being charged with assault of an officer with a motor vehicle a Class A felony and possession of a controlled substance a Class IV Felony.

Lane was arraigned in county court on Tuesday. Lane’s preliminary hearing is set for August 25 at 10 a.m. at the Cheyenne County Court House.
