The Nebraska Board of Pardons will hold a public meeting in the Governor’s Hearing Room, Second Floor, State Capitol, Lincoln, Nebraska on Friday, April 2, 2010 at 1:30 p.m. to hear applications for clemency. The following case from Cheyenne County will be heard:
FOR FULL PARDON:
Charles W. Diedrich for full pardon of felony and misdemeanor convictions wherein he was convicted in Cheyenne County and sentenced on April 28, 1998 to a term of two and one half years probation for the offense of Possession of a Controlled Substance – Methamphetamine; sentenced on March 30, 1999 to a term of two days at the county jail for the offense of Disturbing the Peace; and sentenced on December 7, 2000 to a term of 90 days at the county jail for the offense of Contributing to the Delinquency of a Minor. Brett M. Robertson for full pardon of misdemeanor conviction wherein he was convicted in Cheyenne County and sentenced on January 29, 2004 to a term of 11 months at the county jail for the offense of Attempt of a Class 3A or 4 Felony – Possess Machine Gun / Short Rifle / Shotgun. A meeting of the Mayor & Council of the City of Sidney, Nebraska, was convened in open & public session at 7:15 P.M. on March 9, 2010 in the Council Room. Present were: Mayor Weiderspon & Council Members: Gaston, Filsinger, Van Vleet & Hiett. Others present: City Manager Person, City Attorney Ball & City Clerk Anthony. Notice of the meeting was given in advance thereof by publication in The Sidney Sun Telegraph, the designated method for giving notice. Advance notice of the meeting was also given to the members of the City Council. Availability of the agenda was communicated in the advance notice and in the notice to the City Council. All proceedings shown hereafter were taken while the convened meeting was open to the attendance of the public. Mayor Weiderspon informed the public of the location of the posted Open Meetings Act. Filsinger moved, Gaston seconded “That the minutes of the February 23, 2010 meeting be approved as printed.” Roll call: All Yeas. Agenda Item #4 (Library re-appointment) was taken off of the agenda at this time to be considered in December 2010. Joe Baxter of Olsson Associates gave a report on the progress of the WWTF project. BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF SIDNEY, NE: That the Mayor & Council hereby find and determine that pursuant to a contract heretofore made, the contractor, Industrial Process Technology, has performed the work for constructing the Sidney Waste Water Treatment Project of this city and the engineer for this project, Olsson Associates, has filed with the City Clerk certificates showing the performance of said contract as follows: CERTIFICATE OF PAYMENT NUMBER 9; AMOUNT DUE CONTRACTOR $167,319.00; AMOUNT DUE THE ENGINEER $17,501.25. Payment in the amount now due the contractor and the engineer is hereby authorized and charged to said project in the City of Sidney Waste Water Department budget. At this time, Mayor Weiderspon turned the meeting over to Vice Mayor Hiett to conduct Agenda #6 which related to setting a bid date for the City Animal Impound & Veterinarian Services Agreement. Mayor Weiderspon declared a conflict of interest in this item as he is a veterinarian and may submit a bid. Vice Mayor Hiett announced the agenda item and asked for discussion. City Manager Person explained that it was time to bid out for a new agreement for the animal impound and veterinarian services. City Attorney Ball stated that if approved, bid specifications would be delivered on 3-10-10 for bids to be received by 2:00 P.M. on 3-22-10 and presented to City Council on 3-23-10. Gaston moved, Filsinger seconded “That bids for an animal impound and veterinary services agreement be authorized and said bids be received by 2:00 P.M. on 3-22-10 and presented to City Council on 3-23-10.” Roll call vote: Yeas: Gaston, Filsinger, Van Vleet and Hiett. Nays: None. Abstain: Weiderspon. Vice Mayor Hiett turned the meeting back to Mayor Weiderspon at this time. City Manager Person reported that the City Comprehensive Plan Survey had been sent out to 2,899 residential electric utility customers last week. He explained the process that will be used for the survey and for the updating of the Comprehensive Plan. City Manager Person gave an update on the proposed sales tax legislation LB967. City Attorney Ball gave a report on his research on a definition of “Gifts” as mentioned in the City Council Code of Conduct as per direction of council members. After sharing the different definitions that his research revealed, he presented the following possible definition: GIFT - a present, offering or transfer to an official of anything of value, made gratuitously, without valuable consideration or compensation and without obligation of agreement or contract and, for which value, service or good is not received in return. Council Member Van Vleet made a statement of his ownership of the companies Convert-A-Ball, Endurance Flag and Sidney Farm Supply and that he would abstain in voting on the claims to these companies.
