Registered sex offender charged with failure notify after moving

Timothy Tscharner asked for counsel to be appointed for him yesterday afternoon at the Cheyenne County Courthouse regarding a class IV felony charge against him of violating sex offender laws and failing to inform the sheriff of his new address in writing within five working days of his location change.

The case of the State of Nebraska against Tscharner started with the disappearance of an iPhone and tablet, according to Cheyenne County Court records.

Court documents stated that Dale and Emily Curry, who live on County Road 16 in Sidney, notified authorities earlier this month of the disappearance of one of their iPhones and a tablet.

During the police investigation, authorities questioned Clinton Tscharner, a hired hand of the Curry’s who lives in a mobile house on the property.

Clinton told authorities that his step-son, Timothy Tscharner, lived in the basement of the Curry’s residence due to “a heating problem in the mobile home,” the report stated.

Deputies, having trouble finding information on Timothy, contacted the Cheyenne County Emergency Communications Center on April 11 and requested any reported criminal history in Timothy’s records to assist in the investigation.

Officials at the center informed deputies that he was registered as a sex offender in Arizona.

According to court records, on April 12 deputies contacted the Arizona Department of Public Safety Sex Offender Compliance Division and spoke with Stacey Hodits.

She informed the officers that Tscharner was last seen on NW 12th St. and Jefferson St. in Phoenix, Ariz. and was listed as “homeless.”

To her staff members’ knowledge Tscharner was suppose to be at that location, and he had not contacted Arizona authorities about relocating to Nebraska and had not informed Nebraska authorities of his move.

Deputies then went to the Curry residence and asked for Tscharner, who was in Clinton’s mobile home at the time.

They asked Timothy how long he had been in Cheyenne County and he responded “two days.”

Feeling that they were being given false information, they asked Clinton, who responded that his step-son had been in town for “a couple of months,” according to the documents.

Authorities said that Timothy Tscharner acknowledged that he knew he was not in compliance with the sex offender laws.

Timothy said however that he was unable to get to the Nebraska State Patrol to register and “cited unreliable vehicles as the reason.”

Deputies talked with Emily Curry regarding the time that Timothy had arrived and began living on her property.

Curry confirmed that she picked Timothy up from the bus station on August 20, 2012 and that he has lived at the residence since he began working for them around August 24.

When asked by authorities, Tscharner denied any link to the missing phone and tablet.
