Attorney supports Gipfert appeal decision

Nancy Gipfert immediately filed an appeal bond earlier this month, after being sentenced for a conviction of negligent child abuse, a misdemeanor. She soon dropped the bond, according to court documents. On the same day the bond was dropped, Gipfert informed the court of her intent to submit to the Cheyenne County Sheriff to begin serving her sentence.

Don Miller, the local attorney who represented Gipfert in this case cited several reasons for dropping the bond.

“Financially and emotionally, she and her family are just exhausted,” Miller said.

Gipfert was sentenced to 24 months of probation, the first 90 days to be served in Cheyenne County jail for her part in an incident, which led to the brain injury of an infant in her care. Cheyenne County incarcerates its female inmates in Garden County.

Although Miller clarified that even though the appeal bond was dropped, Gipfert still had 30 days from the sentencing date to file an appeal, she currently has no plans to do such.

“The family wanted to be done with the case and I understand that,” Miller said.

Because of Gipfert’s clean record, as well as the widespread community support asking for a lesser than maximum sentence, Miller stated that Gipfert deserved the opportunity of probation.

“We’re very happy she got probation,” Miller said.

Miller expressed hope that the now two year old victim in the case is fairing well and doesn’t have any permanent brain injury.
