City Council Approves Animal Ordinance

The Sidney City Council on July 13 approved an ordnance that affects pet owners and how they take care of their animals.

Ordinance No. 1824, which amends Section 618 Animals of the Codified Ordinances of the City of Sidney, identifies who is considered the owner of an animal, the definition of animals allowed in the city limits and where and how they can be kept.

The owner of a dog or cat is defined as “anyone who harbors or permits any dog or cat to be harbored for 10 days or more or who lets the same habitually remain and be fed for 10 days or more in or about his house, store or enclosure.”

Horses, sheep, cattle, mules, donkeys, goats, pigs and other hooved or cloven-footed animals are permitted only in areas of the city that are zone A (Agriculture), AR (Agriculture Residential) or R1a (Rural Residential Estate).

The approved amendment says “only one animal per each lot is allowed, or if a lot comprises one acre or more, only one animal per each whole acre is allowed.

The amendment also addresses animal waste. “Any person having the custody or control of any dog or domestic animal, when walking the dog on property not owned by the individual, shall have the responsibility for cleaning up any feces of the animal and disposing of such feces in a garbage receptacle.” The amendment further says it is the responsibility of the person having custody of a dog or domestic animal to have “suitable equipment or materials for the picking up, removal and sanitary disposal of animal feces.”

Additionally, owners will be responsible for cleanliness of the property housing dog and domestic animals frequent enough to not cause odors beyond the property line.

The ordinance goes into effect after its approval, publication and posting as required by law.

The council also discussed a vacancy on the Airport Authority Board. Shannon Odiet, previously with MARC Air, joined the Airport Authority Board in October 2018. Each of the five members of the board serve six-year terms. Odiet submitted his resignation in June. The Airport Authority Board has advertised the position. At the end of two to three weeks, applications received will be given to Mayor Roger Gallaway for consideration.

The council also approved Rauner and Associates for auditing services. In June, City Manager David Scott posted a request for bids for auditing services with one bid received. Fees for auditing services were $47,900 for Fiscal Year (FY) 2020, will be $49,000 for FY21, FY22 $50,470 and $51,984 for FY23.
