Sidney man charged with class II felony

A Sidney man's case was moved up to Cheyenne County District Court following an alleged assault that took place in the alley behind a local bar.

According to the affidavit, at approximately 2:14 a.m. on July 13, a medical team was dispatched to Stewie's Bar in Sidney, where a male victim had claimed to be physically assaulted. A suspect was not on the scene.

The affidavit states that Brian Everingim was found inside Stewie's bar visibly upset and bleeding from the head, nose and mouth.

Everingim identified his assailant as 23-year-old Kevin Maes. Everingim was then taken to Sidney Regional Medical Center by ambulance.

In the affidavit a witness told police that Everingrim was laying in the alley behind Stewie's bar when a male, later identified as Maes, attempted to assist Everingim. When Everingim refused help and pushed Maes away, Maes punched Everingim. When Everingim punched Maes back, Maes began repeatedly punching Everingim.

According to the affidavit officers attempted to find Maes at his residence, but did not find him. After reaching him on his phone, Maes agreed to meet the officers in front of his residence.

In the affidavit Maes told police he had helped his "buddy" Brian to his home. When advised he was under arrest Maes said "no" and plead with officers to not be placed under arrest.

Officers talked a tense Maes into neing placed in restraints, and proceed to the officer's patrol car where Maes resisted, stating he did not want to go or be touched. A pressure compliance tactic was then used to get Maes into the patrol car.

The Affidavit stated that Everingim's injuries were substantial, with a broken orbital bone and broken nose.

Maes was booked for 2nd degree assault, obstruction of a peace officer, and resisting arrest. With the obstruction of justice and resisting arrest charges dropped, Maes is now charged with First Degree Assault.

In Cheyenne County Court Monday, two Sidney Police Officers testified, and the court found there was enough evidence to bound the case up to District Court. Maes will be arraigned on the Class II Felony on August 3rd.

If convicted, Maes could face a prison sentence ranging from 1 to 50 years.
