And More Constitutional Arguments

Continuing from the first Constitutional Argument article let us take a look at a few more amendments that most Americans have little or no knowledge of. I dare say that most of our nation’s public schools do little if any teaching about the Constitution of the United States. As a result we are witnessing more and more trespassing of our rights and freedoms by various levels of government and governmental agencies. So, picking up from where I left off here are a few more constitutional arguments for keeping government (of all levels) out of our homes and businesses.

Amendment III is easy to understand. I says, “No Soldier shall, in time of peace be quartered in any house, without the consent of the Owner, nor in time of war, but in a manner to be prescribed by law.” The “prescribed by law” wording means that there must be a lawfully enacted set of rules and regulations that were enacted by the appropriate governing body... either state or federal. Federally enacted only when approved by a majority of the states. Enough said!

Amendment VI is really important in today’s highly politicized America. It states “In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defense.”

This amendment seems to be totally forgotten (or ignored on purpose) by many in several areas of government, from the federal to the state. I do believe the January 6th Committee grievously violated this one. And certain courts in certain states are currently taking actions that I believe are really stretching the bounds of this amendment. Never forget that what can be done to one of us can be done to any one of us, including you.

Amendment VIII simply states: “Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted. (Hmmmm... me thinks our federalies and certain states have violated this one a few times in the last few years. And, are continually doing so right now. New York city comes to mind.

Here is another short and sweet amendment that is currently being savaged. Amendment IX states: “The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.” This means you and I have God-given rights that have no need to be enumerated! But, in our increasingly God rejecting country more and more people think our rights come from the government (local, state and national). Further, they believe that if men (or women) want to deny these rights to you and I they can do so. This is fast becoming a reality these days. We need to take a stand against this trend or freedom will die in America.

Amendment X states, “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.” Simply put this means that the “United States” (also know as the national government) cannot usurp power that is not “delegated” to it. You and I have the power to enact or remove laws on the local and state level. Unless activities at these levels have an impact on a national level, states are in charge, not the federal government. Me thinks our national government has overstepped the bounds on this one more than once.

Well, this is enough for you to chew on for now. If our nation’s school systems were not so centered on “preparing” our youth for employment then they would have more time to instruct them in how to think for themselves, instead of buying what is scattered about the internet. And, if you are not up to speed on the U.S. Constitution I urge you to get a copy and read it in its entirety. The more we mere citizens know about it, the less Washington bureaucrats will get away with their power grabbing schemes.

One last thing for you to think about – If more American history, including the U.S. Constitution were taught in our school systems maybe there would be less student unrest (aka rioting) and more enlightened participation in our political and governmental areas of America. One can only pray and hope.
