Area Youths Accused in Vandalism Spree Appear in Juvenile Court

Each Face Four Charges From Vandalism and Burglary Incidents; damage in the thousands

SIDNEY-- On Friday afternoon, January 5, two boys, ages 14 and 12, appeared before Hon. Judge Randin Roland, via conference call, on allegations stemming from a recent spate of vandalism and burglary in Sidney. On Thursday, January 4, another boy, age 13, appeared before Hon. Judge Aaron Conn of Chadron via video conference.

The court appointed attorneys for the boys, since many of the charges they face would be felonies if they were adults. The names of the boys cannot be released as they are minors. The court proceedings are the first to be held for the group of youths involved with the recent vandalism and burglary incidents. Two other juveniles will also be appearing related to the allegations.

The 12 year old boy appeared before Judge Roland in the Juvenile Court of Cheyenne County. The 12 year old boy is facing allegations including Class IIA Felony break and enter real estate with intent to commit any felony or with intent to steal property of value, the Sidney Power Plant, between November 22 and November 27, 2023; a Class IV Felony for causing a loss in the amount of more than $5000 at the Sidney Power Plant between November 22 and November 27, 2023; a Class IV Felony for destroying or attempting to damage, injure or destroy any machine, appliance, facility or apparatus owned by a public power supplier that is used for generating electricity; and a Class I Misdemeanor for intentionally causing loss in an amount of more that $1500 but less than $5000, bathrooms at Legion Park, on or about November 22, 2023. A Pre-Adjudication hearing is scheduled for 4 p.m. on February 8 in Juvenile Court of Cheyenne County.

The 14 year old boy also appeared before Judge Roland in the Juvenile Court of Cheyenne County, and is facing allegations including a Class II Misdemeanor for a broken vehicle window, loss amount more than $500 but less than $1,000 from an incident that occurred between November 5 and November 13, 2023; a Class IIA Felony for a real estate break in with intent to steal property of value from the Sidney Power Plant, between November 22 and November 27, 2023; a Class IV Felony for intentional or malicious causing of loss in an amount of more than $5000, property at the Sidney Power Plant, between November 22 and November 27, 2023; and a Class IV Felony with damage, intent to injure or destroy any machine, appliance, facility or apparatus owned by a public power supplier that is used for generating electricity. A Pre-Adjudication hearing is scheduled for 4:15 p.m. on February 8 in Juvenile Court of Cheyenne County.

The 13 year old boy appeared Thursday, January 4, in front of Hon. Judge Aaron Conn of Chadron by video conference. He was accompanied by his mother, foster guardian and attorney. His father was present in the courtroom during the proceeding. The judge reviewed nine charges against the 13 year old. They included: Class II Misdemeanor, maliciously causing loss in an amount of more than $500 and less than $1000 to a vehicle window between November 5 and November 13, 2023; a Class IIA Felony for forcibly breaking and entering real estate with intent to commit a felony or with intent to steal property of value, the Sidney Power Plant, between November 22 and November 27; a Class IV Felony for causing the loss of more than $5000, property at the Sidney Power Plant between November 22 and November 27; a Class IV Felony for willfully and maliciously damaging, injuring or destroying or attempting to damage, injure or destroy any machine, appliance, facility or apparatus owned by a public power supplier between November 22 and November 27; a Class I Misdemeanor for causing loss in an amount of more than $1500 but less than $5000 to restrooms at Legion Park in Sidney on or about November 22; a Class II Felony for using a knife or other deadly weapon, other than a firearm, to commit a felony between November 24 and December 2; a Class IIA Felony for entering real estate with intent to steal property of value; a Class IV Felony for damaging tires in a privately-owned building between November 24 and December 2; and a Class II Misdemeanor for theft valued at less than $500 from a privately-owned building.

The youth was advised to continue to attend school and resume counseling, and a pre-trial conference had been scheduled for January 30.

In all cases, the youths were advised of their rights and informed that if found guilty of felonies, their right to purchase a firearm may be revoked until the age of 25.
